| Gambling Losses Gambling winnings must be reported to the IRS as taxable income and may be offset by gambling losses if you itemize deductions. A husband and wife who are recreational gamblers had more than $44,000 worth of winnings from repeatedly playing casino slot machines. The asserted that they also had $46,500 of offsetting gambling losses, which the IRS disallowed. The taxpayers’ position was that they had credit card and bank account debit cars showing $46,500 in cash withdrawals during the couples’ gambling trips, which indicated that the taxpayers were losing money. In addition, these statements showed money spent at the casinos. The IRS took the position that the taxpayers’ records were insufficient to establish that they sustained gambling losses. | Construction Damage Is Not A Property Taking Construction damage rendering a building unusable does not rise to a taking of a private property interest, a Court has ruled. The Plaintiff owns a church building and property. Two construction projects over which the Department of Transportation and the city has jurisdiction caused vibrations that damaged the church building. The city notified Plaintiff that that the building was a public hazard and ordered it vacated. Unless repaired, the building was to remain unoccupied. Since the cost of repairing the building was at least $3.9 million and its fair market value before the damage was only $580,000, it was not financially feasible to restore the building. read article |

Cigarette Companies Can’t Be Sued For Medicare Costs There is no private right of action against the tobacco companies under the Medicare Secondary Payer stature for the cost of health care services attributable to smoking, a Federal Court has ruled. The Plaintiffs sought to recover for the Medicare program all the expenditures made from May 1998 to the present for the treatment of diseases attributable to smoking. A judge dismissed the complaint, concluding that the Secondary Prayer stature supports no private right to bring a lawsuit against an alleged wrongdoer where the Defendants’ responsibility to pay for health-care expenses of a Medicare beneficiary has not been already established. |
