Delaware Durable Limited Power of Attorney

A Durable Limited Power of Attorney allows someone (known as an attorney in fact) to act in your stead for a specific purpose or purposes, such as to purchase a specific property, execute a certain property, or operate a particular business. Thus, the limited power of attorney, as its name implies, restricts the actions of the attorney in fact to a particular chosen purpose. Some parties may have policies where they only accept a special power of attorney because it is drawn for a specific purpose and may be considered to be a more reliable measure of the actual intent. Also, because the powers granted to the person acting on your behalf (known as an “attorney in fact”) will continue in effect even if you become disabled or lack sufficient mental competence to handle your own affairs, the Limited Power of Attorney is Durable.
