Landlord Had Duty To Protect Visitors From Violent Tenant
A landlord can be sued
for failing to take at least minimal steps to alleviate the risk posed by a
violent tenant, a Court has ruled. The Plaintiff was a former tenant of the
Defendant’s apartment complex who occasionally returned to visit family
still living there. A tenant with a history of intimidating behavior had
previously brandished a firearm at visitors and other tenants. At least one
such previous incident involving the Plaintiff’s family was reported to the
property manager in writing. When the tenant observed the Plaintiff on the
premises, he got a shotgun, shot the Plaintiff twice and beat him before the
police arrived to subdue him. read more |

Decedent’s Mental
Incapacity Tolled Claims
A
decedent’s mental incapacity tolled his claims against a nursing home,
even though he has previously granted a durable power of attorney to his
son, a Court has ruled. The Court found that the statute of limitations
does not run against persons who are protected by law even when there
exists someone who has the authority to bring suit. In this case, the
son had a durable power of attorney. Because the father was mentally
incapacitated while he was a resident at the nursing home, the statue of
limitations remained tolled until the disability was removed. State law
does not contain any language which would lead the Court to conclude
that the legislature intended to remove the disability of unsound mind
upon granting the power of attorney. |

$1.71 Million Medical
Malpractice Award Against Hospital
A
jury has awarded $1.71 million to the family of a woman who died after
childbirth at a hospital. The jury found the hospital was negligent in
the death of the patient. During trial, testimony reveled that the
patient’s artery was cut while personnel were tying off her fallopian
tubes during delivery. The patient bled to death in a hospital room
about six hours later, according to court documents. The Plaintiffs
argued the hospital was negligent in the patient’s death because the
hospital staff should have checked the patient’s blood pressure more
often and should have detected the cut artery well in advance of her
death. The hospital contended the procedures of childbirth and
tube-tying were uneventful and an artery cut such as the one from which
the patient died is a known complication of the surgery that was
performed. The jury disagreed. |
