Summary
A Living Will refers to a person's written or oral indication of the types of treatments he or she wants to receive if he or she becomes ill and cannot communicate his wishes at that time. A person who does not want to receive artificial life sustaining medical treatment can communicate this desire in a Living Will. While the Health Care Proxy names an agent, the Living Will does not name an agent. Instead, the Living Will contains directions that the health care providers follow with regard to the administration of artificial life sustaining treatment. Many states presently have Living Wills statutes.

Description
In advance of or upon an Individual ("Declarant") being determined "terminally ill," and in case the Declarant becomes "incapacitated," said Declarant specifies in writing his desire that his life not be artificially prolonged.

Language
"If at any time I have a terminal condition and if my attending or treating physician and another consulting physician have determined that there is no medical probability of my recovery from such condition, I direct that life-prolonging procedures be withheld or withdrawn when the application of such procedures would serve only to prolong artificially the process of dying, and that I be permitted to die naturally with only the administration of medication or the performance of any medical procedure deemed necessary to provide me with comfort, care, or to alleviate pain."
